I. General Terms and Conditions

The T apply to all services provided by Top Taxi e.U.

The TCs form an integral part of the contract concluded between
Top Taxi e.U. – Taxi Zell am See and the customer.
By placing an order, the customer acknowledges these TCs,
expressly accepts them, and fully agrees to them as part of the contract. Amendments and ancillary agreements
to these TCs always require written form and are only valid for the specific business case.
All terms used in these conditions apply to persons of both
genders.

II. Liability
If the contracting party is a consumer, the entrepreneur’s liability
for slight negligence, with the exception of personal injury,
is excluded.
If the contracting party is an entrepreneur, the entrepreneur’s liability
for slight and gross negligence is excluded.
Top Taxi e.U. – Taxi Zell am See also accepts no liability for the loss
of customers’ personal
items during transport.
The customer is liable to the entrepreneur for any damage caused (incl.
loss of earnings). In particular, the customer is obliged to reimburse all costs incurred by the
entrepreneur due to contamination caused by the customer.
Information regarding waiting or arrival times is non-binding. No liability is assumed for any delays
caused by the entrepreneur.

III. Payment Terms
The customer has the amount agreed upon before the start of the journey after the transport has been completed
immediately to pay, unless otherwise agreed. Even in the event of
the customer’s blameless default in payment, the entrepreneur is entitled to charge default interest
at a rate of 4% above the base interest rate annually.
The entrepreneur is entitled to conclude the contract on condition that the
customer makes a down payment or pays the full fare, provided that the entrepreneur has informed the
customer of the required payment before concluding the contract.
The entrepreneur is not obliged to accept foreign currencies.

IV. Set-off
The customer waives the possibility of set-off. Zur Aufrechnung berechtigt sind
Only customers who are consumers and whose counterclaim is legally related
to the claim, for which an acknowledgment from the entrepreneur exists, or whose
claims have been legally established, are entitled to set-off.

V. Booking
The person making a booking on our website must be over 18 years old
. The customer making a booking is responsible for the personal
data provided in the contract.
Reservations must be confirmed up to 24 hours before the start of the transfer. For
short-notice bookings, we cannot guarantee availability.
For a successful booking, you will receive a confirmation email. In case you
have not received your confirmation email, or your booking details
were entered inaccurately, please contact us. Please print your confirmation
and have it with you. The contract is concluded upon acceptance by
Top Taxi E.U. – Taxi Zell am See by sending a booking confirmation.
Ancillary agreements and
amendments to the concluded contract require our written confirmation.

VI. Withdrawal from the Contract; Cancellation Fee
If an agreed transport order is canceled by the customer, the entrepreneur must be reimbursed for the
costs already incurred, at least 20% from the 3rd working day before the scheduled date
and 40% from the 1st working day before the scheduled date of the agreed or resulting
fee as a cancellation charge. If the cancellation occurs only
on the day of the scheduled appointment, the cancellation fee is 70% of the fee.
If the customer does not appear at the agreed pick-up location at the agreed pick-up time and
no timely withdrawal has been declared by the customer, the entire agreed price of the transport becomes due
after 15 minutes.
Furthermore, the customer is obliged to reimburse all expenses and, in the event of the customer’s fault,
all damages incurred due to the cancellation.
If a down payment was agreed upon and subsequently not made by the agreed
due date, the entrepreneur can withdraw from the contract without a grace period.

VII. Force Majeure
If the fulfillment of the contract becomes impossible due to force majeure, the entrepreneur can terminate the
contract without observing a notice period. Due to traffic jams or other traffic conditions,
accidents, etc., or vehicle breakdowns not directly caused by Top Taxi e.U. Top Taxi e.U.
Taxi Zell am See assumes no liability. Any claims for
damages, etc. by the customer are excluded.

VIII. Place of Performance, Jurisdiction, and Choice of Law
This contract is subject to Austrian formal and substantive law, excluding
the rules of international private law and the UN Convention on Contracts for the International Sale of Goods.
For disputes arising from the contract, the exclusive jurisdiction of the court responsible for the
company’s location is agreed upon. If the customer is a consumer
within the meaning of the KSchG and has their main residence or habitual
abode in Austria or is employed in Austria, this jurisdiction agreement only
applies if the company’s registered office is located in the district of the customer’s main residence, habitual
abode, or place of employment.
