General Terms and Conditions (T)<\/span><\/strong><\/p>\n

I. General Terms and Conditions<\/p>\n

\nThe T apply to all services provided by Top Taxi e.U.<\/p>\n

The TCs form an integral part of the contract concluded between
\nTop Taxi e.U. – Taxi Zell am See and the customer.
\nBy placing an order, the customer acknowledges these TCs,
\nexpressly accepts them, and fully agrees to them as part of the contract. Amendments and ancillary agreements
\nto these TCs always require written form and are only valid for the specific business case.
\nAll terms used in these conditions apply to persons of both
\ngenders.<\/p>\n

\nII. Liability
\nIf the contracting party is a consumer, the entrepreneur’s liability
\n for slight negligence, with the exception of personal injury,
\nis excluded.
\nIf the contracting party is an entrepreneur, the entrepreneur’s liability
\n for slight and gross negligence is excluded.
\nTop Taxi e.U. – Taxi Zell am See also accepts no liability for the loss
\nof customers’ personal
\nitems during transport.
\nThe customer is liable to the entrepreneur for any damage caused (incl.
\nloss of earnings). In particular, the customer is obliged to reimburse all costs incurred by the
\nentrepreneur due to contamination caused by the customer.
\nInformation regarding waiting or arrival times is non-binding. No liability is assumed for any delays
\ncaused by the entrepreneur.<\/p>\n

\nIII. Payment Terms
\nThe customer has the amount agreed upon before the start of the journey after the transport has been completed
\n immediately to pay, unless otherwise agreed. Even in the event of
\nthe customer’s blameless default in payment, the entrepreneur is entitled to charge default interest
\nat a rate of 4% above the base interest rate annually.
\nThe entrepreneur is entitled to conclude the contract on condition that the
\ncustomer makes a down payment or pays the full fare, provided that the entrepreneur has informed the
\ncustomer of the required payment before concluding the contract.
\nThe entrepreneur is not obliged to accept foreign currencies.<\/p>\n

\nIV. Set-off
\nThe customer waives the possibility of set-off. Zur Aufrechnung berechtigt sind
\nOnly customers who are consumers and whose counterclaim is legally related
\nto the claim, for which an acknowledgment from the entrepreneur exists, or whose
\nclaims have been legally established, are entitled to set-off.<\/p>\n

V. Booking
\nThe person making a booking on our website must be over 18 years old
\n. The customer making a booking is responsible for the personal
\ndata provided in the contract.
\nReservations must be confirmed up to 24 hours before the start of the transfer. For
\nshort-notice bookings, we cannot guarantee availability.
\nFor a successful booking, you will receive a confirmation email. In case you
\nhave not received your confirmation email, or your booking details
\nwere entered inaccurately, please contact us. Please print your confirmation
\nand have it with you. The contract is concluded upon acceptance by
\nTop Taxi E.U. – Taxi Zell am See by sending a booking confirmation.
\nAncillary agreements and
\namendments to the concluded contract require our written confirmation.<\/p>\n

\nVI. Withdrawal from the Contract; Cancellation Fee
\nIf an agreed transport order is canceled by the customer, the entrepreneur must be reimbursed for the
\ncosts already incurred, at least 20% from the 3rd working day before the scheduled date
\nand 40% from the 1st working day before the scheduled date of the agreed or resulting
\nfee as a cancellation charge. If the cancellation occurs only
\non the day of the scheduled appointment, the cancellation fee is 70% of the fee.
\nIf the customer does not appear at the agreed pick-up location at the agreed pick-up time and
\nno timely withdrawal has been declared by the customer, the entire agreed price of the transport becomes due
\nafter 15 minutes.
\nFurthermore, the customer is obliged to reimburse all expenses and, in the event of the customer’s fault,
\nall damages incurred due to the cancellation.
\nIf a down payment was agreed upon and subsequently not made by the agreed
\ndue date, the entrepreneur can withdraw from the contract without a grace period.<\/p>\n

\nVII. Force Majeure
\nIf the fulfillment of the contract becomes impossible due to force majeure, the entrepreneur can terminate the
\ncontract without observing a notice period. Due to traffic jams or other traffic conditions,
\naccidents, etc., or vehicle breakdowns not directly caused by Top Taxi e.U. Top Taxi e.U.
\nTaxi Zell am See assumes no liability. Any claims for
\ndamages, etc. by the customer are excluded.<\/p>\n

\nVIII. Place of Performance, Jurisdiction, and Choice of Law
\nThis contract is subject to Austrian formal and substantive law, excluding
\nthe rules of international private law and the UN Convention on Contracts for the International Sale of Goods.
\nFor disputes arising from the contract, the exclusive jurisdiction of the court responsible for the
\ncompany’s location is agreed upon. If the customer is a consumer
\nwithin the meaning of the KSchG and has their main residence or habitual
\n abode in Austria or is employed in Austria, this jurisdiction agreement only
\napplies if the company’s registered office is located in the district of the customer’s main residence, habitual
\nabode, or place of employment.<\/p>\n
